site and had nothing to do with the urban transformation, as a result, this
project started with the principle of “on-site transformation” was introduced
as a “displacement of residents” project by obstructing the evacuation and
demolishing process. Even though an agreement was reached with a large
part of the beneficiaries during the transformation process, the start of
construction was delayed by one and a half year due to judicial processes as a
result of the lawsuits filed. Therefore, prolongation of this period led to public
loss with the increasing construction costs, in addition to aggrievement of
majority of reconciled beneficiaries due to the delay of the project. Currently,
the construction works of the project are progressing at a fast pace. When this
project, which will be a turning point for Tokatköy, is completed, beneficiaries
will receive their earthquake-resistant legally built houses, with a completed
infrastructure, complying with zoning legislation.
4.3. Orta and Dumlupınar Neighbourhood of Pendik District 1st Phase Urban
Transformation Project
Approximately 91.33 hectares of area located in Orta and Dumlupınar
Neighborhoods of Pendik District, where 92% of the building stock was built
before the year 2000, with non-earthquake resilient and unhealthy structures, was
declared as a “High Risk Area” in 2013 in order to control urban development,
ensure sustainable urban development, create a healthy and safe residential
area. The declaration of High Risk Area was cancelled by a court decision
in 2016 as a result of lawsuits filed with the claim that technical examination
was not performed to the extent stipulated by the Law and Implementing
Regulation, thus transformation activities could not be launched.
The area was re-examined according to the Law No. 6306, and the area
within the boundaries of the Orta and Dumlupınar Neighborhoods, with totally
105.60 hectares, was declared as a “High Risk Area” again on 13.02.2017, taking
into account the grounds for cancellation. Following the declaration, studies
were started in the area for the implementation of transformation activities.
In order to carry out the implementation in the risky area effectively,
the area of about 14 hectares located in the northwest and surrounded by
important transportation axis was determined as the 1st Phase project area
in 2020 and the Ministry initiated the works. As a result of the negotiations
for reconciliation that started after the detection studies, a 99% agreement
rate was reached in a short time with the great support of our citizens to the
project. In accordance with the determinations made and the technical report
prepared by the university, it was decided that the implementation to be
continued on the site in 2022 will be carried out in accordance with Article 6
/ A of Law No. 6306, and within this scope, all real property in the area was
