Urban Transformation in Istanbul Within the Scope of Disaster
Preparedness
Beneficiaries were identified in this area, project studies were carried out,
and the properties in all real estates belonging to beneficiaries were directly
transfered to the State Treasury in accordance with the provisions of article
6/A, thus ensuring that there would be no disruptions and delays in the project
and construction process.
During the temporary housing process of the rights holders who were
evacuated from the area, rent allowances were started to be paid in accordance
with the provisions of Law No. 6306, and the area was made ready for the
construction of the project with demolition activities after the evacuation.
Construction phase of the project prepared by the Ministry has been
immediately set off and the construction of 727 residential units and 18
commercial units has been completed. Following the determination of
beneficiaries and valuation of the existing assets within the framework of
relevant legal regulations, new houses and workplaces were delivered to
the beneficiaries after drawing lots for these structures considering their
valorisation, and resided by them as of March 2023.
As can be seen in the example of the Yahya Kemal Transformation
Project, the implementation of Article 6 / A of the Law allows preventing any
unwanted events and delays in the process of reconciliation with beneficiaries,
accelerating the other processes and providing the beneficiaries with new,
safe houses in the shortest way without any disruption since the operations
can be directly performed.
5. Conclusion and Evaluation
Throughout the history, Türkiye was struck by major disasters; including
the earthquakes, in particular, causing great loss of life and property along
the country. New legal regulations have been put forward following the
disasters in order to prevent material and moral losses and to become ready
for disasters. The last of these legal regulations was the Law No. 6306, which
entered into force in 2012 after the Van earthquake in order to create safe
and secure housing areas and to ensure the safety of life and property. This
law aimed to prepare cities for disasters, to ensure the transformation of
residential areas that pose a risk among the existing building stock; many
applications are carried out throughout the country in high risk buildings, high
risk areas or reserve building areas prone to disasters.
Minimizing all kinds of material and non-material losses in the event of a
possible earthquake imposes important responsibilities on all stakeholders.
It is quite obvious that the value of the heavy human losses caused by the
earthquake cannot be compared with any financial value. Besides, the loses
caused by the earthquake on the country’s economy in the short term and
